Workplace Law Under President Trump: What to Expect

Session One: August 9, 2017

Receive an informative analysis of President Trump’s first 100 days in office and his Administration’s likely impact on labor and employment law.  Participants will hear about legal issues facing employers including progress and setbacks in remaking federal employment policy, as well as increasing importance of our state and local employment laws.

Learning objectives:
  • Understand the impact of the current appointments and agendas on employment law for the NLRB, EEOC and USDOL
  • Discuss the decisions from the SCOTUS session that ended in June 2017 and determine what will affect workplace law
  • Review decisions from Appellate Courts impacting issues such as arbitration agreements, Title VII protection of sexual orientation and rulings on Executive Orders

Up Your ADA Game: Essential Accommodation Concepts

Session Two: September 13, 2017

Dealing with issues related to workplace accommodation requests can be a daunting task—even for seasoned HR and legal professionals. The path to a successful interactive process and a meaningful analysis of an accommodation request is fraught with landmines at every turn. This interactive session will examine actual examples to develop strategies to effectively manage the interactive process, including reviewing requests for accommodation, best practices for the interactive process, undue hardship analysis, and resources for employers to assist in the process.

  • Develop strategies to effectively manage the interactive process including reviewing requests for accommodations.
  • Discuss and exchange information and best practices for the interactive process and undue hardship analysis.
  • Recommend resources available for employers to assist them in their policies and procedures when it comes to the interactive process and accommodations.

Adapting to the Ever Shifting Wage Hour Landscapes

Session Three: October 18, 2017
8:00 AM - 10:00 AM

Presented by: Katrin U. Schatz, JD

During this session, attendees will learn of the recent proposed changes to the FLSA including areas such as the DOL’s Overtime Regulation that was blocked by a Texas Judge at the end of last year; classifying employees as exempt or non-exempt from overtime, examining job duties as well as compensation practices such as deductions from wages. Additionally, we will review the status of the challenges to the new rules and the expected revisions under the Trump administration. Finally, participants will look at preventative strategies and what employers can do now to ensure compliance when the DOL comes to their door.

Learning Objectives:
  • Discuss the most recent proposed changes to the FLSA
  • Review the status of the challenges to the new rules and key factors to consider when preparing  for enforcement and how an employer can be compliant.
  • Understand how to properly calculate overtime; proper treatment of meal and rest periods; using a fluctuating workweek correctly; timekeeping procedures and recordkeeping.

FMLA: Fighting Abuse

Session Four: November 8, 2017

Employers are faced with an increasing number of – and often conflicting – federal, state and local laws impacting how to manage employees with disabilities, illness and family/personal obligations. Participants will discover how to address these unique situations and implement preventative strategies by discussing real cases.

  • Address long-term and open-ended leave requests
  • Manage FMLA and social media issues
  • Examine and discuss real cases of FMLA abuse along with preventative strategies
