SOLD OUT-Workplace Investigations: Law, Procedure and Best Practices

The workplace investigation is the first line of defense when it comes to any workplace claim. Many times, the investigation will determine whether or not an employee pursues a claim further. Thus, the investigation is the critical moment for every employer facing a claim, and that important task almost exclusively falls to human resources. This workshop is designed to train human resources personnel on all aspects of a workplace investigation. 

Through this six-hour program, attendees will hear from two employment lawyers about every aspect of workplace investigations, from the pre-investigation issues and concerns all the way through completion and distribution of findings. Attendees also will learn through the unique experience of mock investigations throughout the day. Attendees will even have the opportunity to be a participant in the mock investigations.

Participants will:
  • Learn how to recognize when a workplace investigation is necessary and what complaints should implicate an investigation
  • Be able to determine when to conduct the investigation in-house versus hiring outside counsel or a third-party investigator
  • Once making the determination of an in-house versus outside investigation, learn how to determine who should conduct the investigation under each scenario
  • Learn the steps to conducting a workplace investigation procedurally from beginning to end
  • Gain knowledge regarding what documentation should and should not be created during an investigation and what documentation should and should not be maintained during an investigation
  • Learn how to properly close an investigation and distribute findings

About the Speakers

PAUL W. SIMON, JD, MANAGING PARTNER, SIMON | PASCHAL PLLC

Paul is a founding member of Simon | Paschal PLLC, an employment and business law boutique firm in Dallas, Texas. Before forming and managing his own law firm, Paul practiced employment, business and immigration law at another law firm in Dallas. Paul graduated from Hope College and Michigan State University College of Law, where he graduated magna cum laude.

Paul has a wide array of experience in employment matters, including Title VII, state discrimination laws, the ADA, the ADEA, the FLSA, the FMLA, employment contracts, non-competition and non-solicitation agreements, and numerous other employment laws and regulations. Paul also has a broad business-based practice including, business entity formation and dissolution, operating agreements, and contract drafting and review.

Paul is both an active transactional attorney and a litigator. Paul regularly appears before state and federal courts on behalf of his clients and he defended one employer client in a federal jury trial, where he helped obtain a favorable jury verdict. In addition to his work as a litigator, Paul serves as an outside general counsel for many of his clients, a role in which he regularly represents employers before the TWC, EEOC and various other government agencies; creates and implements employee and management training; reviews and drafts employment handbooks and policies and procedures; reviews and drafts various employment-related contracts; and provides regular advice and counseling on a myriad of human resources issues. In that role, he also assists clients with their business formation and contractual needs.

Paul is a member of the State Bar of Texas, the Dallas Bar Association and the Dallas Association of Young Lawyers. Paul is a three-term member of the DAYL executive committee, where he currently serves as vice president. Paul has been selected both as a Texas Super Lawyer and a Texas Super Lawyers Rising Star. Paul previously has presented on various employment law topics at The HRSouthwest Conference and to DallasHR, the local SHRM affiliate chapter.

Paul is married to his high school sweetheart; and while they are not native Texans, they moved here as fast as they could.

DUSTIN A. PASCHAL, JD, MANAGING PARTNER, SIMON | PASCHAL PLLC

Dustin is one of the founding members of Simon | Paschal PLLC, an employment and business law boutique firm in Dallas, Texas. Prior to starting and managing his own firm, Dustin exclusively practiced employment law at another law firm. Dustin has a degree in human resource management from Baylor University and a law degree from Baylor Law School.

Dustin maintains an active advice and counsel practice in addition to his litigation work. Dustin’s practice includes matters related to Title VII, state discrimination laws, the ADA, the ADEA, the FLSA, the FMLA, employment contracts, non-competition and non-solicitation agreements, and numerous other employment laws and regulations. He also has experience with general contractual and commercial matters.

In his role as a litigator, Dustin appears before state and federal courts and arbitration panels to advocate on behalf of his clients in hearings, injunction proceedings and trials. Outside litigation, Dustin serves as an outside general counsel for many of his clients, a role in which he regularly represents employers before the TWC, EEOC and various other government agencies; creates and implements employee and management training; reviews and drafts employment handbooks and policies and procedures, reviews and drafts various employment-related contracts; and provides regular advice and counseling on a myriad of human resources issues.

Dustin is a five-term member of the DAYL board of directors and a member of the DallasHR board of directors, where he serves as a co-director of the Employment Law & HR Compliance Committee. Dustin also has been selected as a Texas Super Lawyers Rising Star for four consecutive years, beginning in 2012. Dustin has presented on numerous employment topics to various organizations including, the Urban League of Dallas, Heart of Texas SHRM, DallasHR, The HRSouthwest Conference and the Baylor Hospital Cvetko Cancer Center. 

Dustin is married with two dogs, and his wife is an HR professional, which makes discussions at home always interesting.
